GENERAL CONDITIONS OF SALE

PRELIMINARY

The website is owned by: Nafaru Home SL (hereinafter, “Nafarù”).

It is the responsibility of the user (hereinafter, the "User") to know the General Conditions of Sale (hereinafter, the "GENERAL CONDITIONS OF SALE") in force at the time the Purchase process begins.

The User, by accepting the conditions, declares to be of legal age and have sufficient legal capacity to be bound by these GENERAL CONDITIONS OF SALE.

Please carefully review the product information for its specific terms of sale. These GENERAL CONDITIONS OF SALE may be completed or modified by specific clauses or conditions indicated in certain products, especially with regard to the right of withdrawal, changes or refunds.

Nafarù can modify these GENERAL CONDITIONS OF SALE at any time. These possible modifications will not affect in any case the purchases that have been made prior to the entry into force of said modifications, which will be governed in any case by the GENERAL CONDITIONS OF SALE in force at the time of making said purchase.

These GENERAL CONDITIONS OF SALE may be saved and reproduced at any time by the User who makes a purchase through the options of his Internet browser and must be read and accepted before finalizing the purchase.

REGISTRATION AS A USER

In order to access the electronic purchase of Nafarù products, it is necessary to register as a User of the page www.nafaru.com. The purchase cannot be made without registration.

Registration as a User is free and must be done through the "Register" tab available on the website itself. At the end of the registration process, the User will receive an email at the address indicated by the User, confirming that the process has been carried out correctly.

The User may access the section of registered users with their username and password (or through the means that, in each case, Nafarù enables to authenticate Users). In his profile, the User will be able to find relevant information such as that related to previous orders or the shipping address provided.

TERM OF VALIDITY OF THE OFFER

Without prejudice to the provisions of the specific legislation, electronic contracting offers or proposals will be valid during the period set by Nafarù or, failing that, for as long as they remain accessible to the recipients.

PURCHASING PROCESS

The purchase process consists of the following steps:

(i) Selection of products: Browse our page and press the "Add to Cart" button each time you want to add a product to the purchase. The shopping cart contains the name of the selected product, the quantity and the price in euros.

(ii) Start of the purchase process: To start the purchase process, click the "Proceed to payment" button.

(iii) Filling in the purchase data: Prior to selecting the payment method, you must fill in the purchase data and correct any errors produced in entering them. Once you have verified your details, confirm your order.

(iv) Selection of the means of payment: Select the means of payment you prefer, accept these GENERAL CONDITIONS OF SALE by checking the corresponding tab, and press the "Complete order" button. At that time, the contract will be perfected for all purposes.

(v) Purchase confirmation: Once we receive your acceptance, Nafarù will issue an on-screen confirmation that you can file and that will contain the following information:

- Order number.

- Order date.

- Summary of the products included in the purchase.

In any case, Nafarù will issue a confirmation of the purchase by email within a maximum period of 24 hours from receipt of the purchase order.

Throughout the purchase process you can consult these GENERAL CONDITIONS OF SALE, as well as know the final price of the selected products.

Once the purchase is confirmed, the customer may not modify or cancel the order outside of the cases provided for by law or in these GENERAL CONDITIONS OF SALE.

PRICE, TAXES AND DELIVERY COSTS

All the prices indicated on the website are referred to in euros and include those taxes and fees applicable to the Spanish territory, without prejudice to the fact that the purchase of the products from another territory could accrue the corresponding taxes and/or corresponding tariffs. Nafarù, through the bank details entered by the User on the website, will make a withholding for the final amount of the order.

At the end of the purchase process, the User must choose the desired shipping method. The shipping costs will appear detailed at the end of the purchase process and will be borne by the User in its entirety.

Prior to the acceptance of the order, the User will be able to know the full final price of the same, breaking down, where appropriate, the amount of the increases or discounts applied, as well as the transport costs, taxes, tariffs or other additional services.

The prices of the products may change at any time depending on the pricing policy of Nafarù. Products purchased will be billed at the price in effect at the time of purchase.

PAY

Users may pay the price of the products purchased by any of the following means:

a) Through debit or credit cards issued by European financial institutions.

The payment of the user's order occurs in real time through the Virtual POS once it has been verified that the data provided is correct.

b) Through Apple Pay

c) Through Google Pay

c) By bank transfer.

d) Through Klarna or afterpay.

This is a payment method that allows you to divide or postpone your order in installments quickly and easily, without paperwork. Dividing the payment of your order into 3 equal payments, without any added cost.

BILL

The User accepts that Nafarù sends the proof of purchase by email, to the address provided by the User. The User may revoke their consent to receive the invoice in electronic format, at any time, by sending us an email to support@nafaru.com. In addition, the User can in any case request a copy of the paper invoice at support@nafaru.com.

Likewise, Nafarù allows the User to download the invoice from the "My Orders" section in the User's personal account section. Once the order for which he wants the invoice has been selected, the User must click on the "Download Invoice" button.

DELIVERY

Orders will be dispatched within the following territories: Metropolitan France (includes Corsica)

Home delivery will be made from Monday to Friday. The User may specify any detail related to the shipment, as well as the delivery method, according to the options provided by Nafarù at any time. The additional charges regarding the transport and delivery of the products will be informed to the User during the purchase process.

LIABILITY FOR DELIVERY

The User will acquire ownership of the products that are the object of the purchase once the entire agreed price has been paid.

The assumption of risk by the User with respect to the products will take place at the time of their delivery, regardless of the moment in which the User acquires ownership of the products. Therefore, Nafarù will not be responsible for any theft, robbery, deterioration, damage or loss of the products that occurs after the delivery of possession of these to the User.

Each delivery is considered made from the time the product is made available to the User or to a third party authorized by the latter, materialized by the control system used by the carrier. It is up to the recipient to check the order at the time of delivery and then make all reservations and claims that appear justified, even having the possibility of rejecting the package, if it has been opened or if it has obvious signs of deterioration.

Reservations and claims about any incident in the delivery of the products should be addressed to Nafarù by email at the following address support@nafaru.com.

AVAILABILITY

In case of unavailability of the product after the order has been placed, the User will be informed by email of the cancellation of the order.

Nafarù does not guarantee the permanent availability of the products, being exonerated from any type of responsibility as long as it does not cause an intentional breach on the part of Nafarù, or that it derives from errors in the unavailability of the service of the data transfer telematic networks. beyond their will.

CANCELLATION OF ORDERS

Once the order has been placed, it cannot be canceled since it goes directly to the manufacturing process in an automated way.

RETURNS

Returns of standard products.

To process the return of standard products, send us an email to support@nafaru.com and we will inform you how to proceed and send us the material back, in its original packaging and in perfect condition.

For the return, shipping and handling costs are generated that have to be paid by the customer. We will inform you in more detail depending on the products you want to return.

Claims for open or lost packages will not be accepted if the incident is not stated on the delivery note of the transport agency.

The refund of the purchase amount will be made with the same means of payment used to pay for the order and, in any case, within a maximum of fourteen (14) calendar days from the reliable receipt of the withdrawal request, as long as it is Nafarù who manages the collection of the product. In the event that the User returns the product through a transport company of his choice, the refund of the purchase amount will be made from the moment Nafarù has effective knowledge of the shipment of the product or, failing that, from the moment it is received. .

In the event that the products do not arrive in perfect condition, Nafarù reserves the right to pay a lower amount for your order, being able to endorse those amounts that the User must pay for breach of the obligations established herein.

Returns of personalized products.

Customized products cannot be returned as established by the law regulated by directive 2011/83/EU of the European Parliament and of the Council of October 25, 2011 on consumer rights.

“This directive establishes that consumers have the right to withdraw from the purchase contract without the need for justification within a period of 14 calendar days, counting from the receipt of the product. However, there are exceptions to this right, and one of them is when the product is personalized or made to measure according to the customer's specifications, since its return is not possible due to the fact that it is a product made specifically for a specific person."

Defective or damaged product during transport

Before opening a product, the User must verify (i) the conformity and condition of the packaging and that (ii) the number of packages delivered correspond to what is indicated on the delivery note. In the event that the User detects any anomaly before opening the product, Nafarù requests that the seal or its packaging not be opened, and that the User write on the delivery note "accepted with reservation", specifying the reasons for their disagreement.

Likewise, if the product has been damaged during transport, it is essential that the User write it down on the carrier's delivery note.

In the event that the User is not satisfied with the status of the products delivered, they must immediately contact Nafarù by email at support@nafaru.com and always within 24 hours of receipt of the order. CUSTOMER SERVICE AND DISPUTE RESOLUTION

In accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council of May 21, 2013, the User has the right to request the extrajudicial resolution of disputes.

WARRANTY

In the event that the User acts as a consumer and user, all our products are guaranteed at the national level, against manufacturing defects for 2 years, except for those products that indicate another term. If you have purchased the products after January 1, 2022, the warranty period will be 3 years.

The guarantee is expressly excluded in the following cases:

a) Transport, accidents, improper use and other damages not due to the normal use of the product by the client after the delivery of the merchandise. This guarantee only covers transport damage caused before the material is received.

b) Transport of the product without the original packaging.

c) Burns, cuts, scratches, wrinkles, signs, scratches or other damage caused by animals or by improper use of the product.

d) Use or contact with chemical products (acids, solvents, dyes, paint, ammonia, lacquers or other hairdressing products...) or treatment with cleaning products not indicated for the specific upholstery of the guaranteed product.

e) Deterioration of color due to exposure of the product to the action of sunlight or other sources of heat.

f) Damages and indirect losses of any kind.

g) Damages, personal and/or material, caused as a consequence of non-compliance, by the User, with the rules and instructions given by Nafarù for the installation, use and maintenance of the product.

FORCE MAJEURE

Nafarù will not be liable for the total or partial breach of the obligations derived from this contract or for the delay in carrying them out if said breach is due to a circumstance of force majeure, including general, territorial or sectoral strikes, flood, fire, pandemic etc

PERSONAL DATA PROTECTION

In compliance with the provisions of Organic Law 3/2018 of December 5 and EU Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of natural persons with regard to the treatment of personal data and the free circulation of these data, and in the current regulations applicable at all times, we inform you that your personal data collected through this document will be processed by Nafarù Home, SL in order to comply with the commercial relationship between you and our company.

Personal data may be communicated to third parties provided that said communication responds to a need for development, compliance and control of the commercial relationship, and/or is limited to the aforementioned purposes, in accordance with current regulations applicable to the matter. .

We inform you that you can exercise your rights of access, rectification, cancellation, opposition, limitation of treatment and portability at any time at the registered office of the merchant indicated above or by sending an email to the following address: support@nafaru.com.

INTELLECTUAL PROPERTY

Nafarù will retain all intellectual and industrial property rights, including rights to business secrets, relating to all plans, standards, paintings, diagrams, graphic material, photographs, design samples, content and other documents, whether in electronic format , printed, as preprint material or brochures that will be delivered to the User in the context of manufacturing, testing, demonstrating and marketing its products.

The User acknowledges that, by virtue of these GENERAL CONDITIONS OF SALE, Nafarù does not assign or transfer to the User any Intellectual and/or Industrial Property rights owned by it, or over any rights of third parties. Nafarù only authorizes the User to access and use them in accordance with the terms indicated in these GENERAL CONDITIONS OF SALE. Therefore, Nafarù does not grant any other license or authorization to use the User on Intellectual and/or Industrial Property rights other than that which is expressly detailed in this clause.

NULLITY OR ANNULLATION

If any of the clauses of these GENERAL CONDITIONS OF SALE is null, voidable, illegal or unlawful, in such case, and in the broadest interpretive sense permitted by law:

a) Said declaration will not invalidate the rest of the GENERAL CONDITIONS OF SALE, which will maintain its validity and effectiveness; and

b) The null or voidable clause or clauses must be replaced or adjusted preferably to be annulled.

APPLICABLE LAW AND JURISDICTION

These GENERAL CONDITIONS OF SALE will be governed or interpreted, in everything not expressly provided herein, in accordance with Spanish legislation, and in particular by Law 34/2002 on Services of the Information Society and Electronic Commerce. The language for the conclusion of the contract will be Spanish.

Nafarù and the User agree to expressly waive any other jurisdiction that may be applicable and submit any controversy that may arise from the provision of the products or services subject to these GENERAL CONDITIONS OF SALE to the courts and tribunals corresponding to the User's address. Additionally, the consumer may opt for the jurisdiction of the courts of the city of Malaga (Spain).

If the User is contracting as a consumer or user, nothing in this clause will affect the rights recognized as such by current legislation.
